半正式治理的现代转型——以宁海“老娘舅人民调解中心”为例

摘　　要：在社会转型期,半正式治理仍能发挥积极作用,并随着国家治理现代化进程而实现了现代转型。宁海“老娘舅人民调解中心”的案例提供了一个分析范本。在快速城镇化进程中,地方社会矛盾凸显,地方政府通过吸纳“老娘舅”,既回应了国家治理法治化建设要求,又有效解决了地方社会转型的内生需求。半正式治理发挥作用,主要是双向动员和重置社会机制的结果。老娘舅案例既昭示着启用地方资源的本土化转型路径,也呈现了国家和社会相互融合的积极面向,为我们提供了一种有效的半正式治理现代转型方案。In the period of social transition,semi-formal governance can still play a positive role and has achieved modern transformation with the process of national governance modernization.The case of“Old Mother's Uncle People's Mediation Center”in Ninghai provides a model for analysis.In the process of rapid urbanization,local social conflicts have come to the fore.By incorporating“maternal uncles”,local governments not only respond to the requirements of national governance and rule of law construction,but also effectively address the endogenous needs of local social transformation.Semi-formal governance works mainly as a result of dual mobilization and resetting of social mechanisms.The case shows both the localized transformation path of enabling local resources and the positive orientation of mutual integration of state and society,which provides us with an effective modern transformation solution of semi-formal governance.
