摘 要:《联合国海洋法公约》(UNCLOS)为各国处理海洋事务提供了一个法律框架,但现如今《联合国海洋法公约》所构建的海洋法律秩序具备突出的模糊性与滞后性,已不能满足南海海域治理的需要。“南海行为准则”应运而生,“南海行为准则”中既有对公认海洋习惯法的承认,也在规则的制定方面具有自己独特的创新之处,中国应把握机会主导和引领“南海行为准则”的实现,从而在国际海洋治理方面增加话语权。The United Nations Convention on the Law of the Sea provides a legal framework for States to deal with ocean affairs,but nowadays,the maritime legal order constructed by the United Nations Convention on the Law of the Sea has outstanding ambiguity and lag,which can no longer meet the needs of South China Sea area governance.The"South China Sea Code of Conduct"came into being.The"South China Sea Code of Conduct"not only recognizes recognized custom-ary maritime law,but also has its own innovations in the formulation of rules.China should seize the opportunity to lead and lead the realization of the"South China Sea Code of Conduct",so as to increase its voice in international ocean governance.
