工程质量处理司法鉴定中存在的问题与案例分析

摘　　要：建设工程质量的司法鉴定是处理建设工程司法纠纷案件的主要依据,与控辩双方均有较大的利害关系。此类司法鉴定主要分为建设工程质量鉴定、加固处理方案鉴定和施工造价鉴定三部分。论文重点分析建设工程质量及处理方案中存在的问题,应该坚持的原则;建设工程处理方法鉴定的特点;研究此类鉴定中存在的问题。并以具体案件为例说明了二者的相关性;对房屋存在的工程质量问题及加固处理方案进行了鉴定,并对控辩双方提出的质疑进行了解答,为法院裁决提供有效的支撑。司法鉴定人应坚持客观公正,结合专业知识有据可依,科学严谨地做出鉴定结论。The forensic appraisal of construction project quality is the main basis for dealing with construction project judicial dispute cases,which has a great interest with both the prosecution and the defense.This kind of forensic appraisal is mainly divided into three parts:construction project quality appraisal,reinforcement treatment scheme appraisal and construction cost appraisal.This paper mainly analyzes the problems existing in the construction project quality and treatment scheme,and the principles that should be adhered to;Characteristics of identification of construction project treatment methods;Study the problems existing in such identification.A specific case is taken to illustrate the correlation between the two;The project quality problems existing in the house and the reinforcement treatment scheme were identified,and the questions raised by the prosecution and the defense were answered,so as to provide effective support for the court's ruling.The judicial appraiser should adhere to objectivity and impartiality,combine professional knowledge with evidence,and make scientific and rigorous appraisal conclusions.
