摘　　要：目前医疗机构法治建设仍面临着较多挑战,如医疗机构管理人员法治意识有待提高、依法决策和依法运行发展仍不平衡、依法推进医疗机构发展和解决纠纷的能力仍需强化等。作者通过调查问卷、专家座谈等方式,对国内67家医疗机构的管理者、2 956名医务人员、9 787名卫生行政主管机关工作人员进行问卷调查,以了解全国各地医疗机构法治建设现状,探讨医疗机构法治建设在顶层设计、体制机制、重视程度方面的不足。在此基础上,从明确医疗机构法治建设内涵和完善法律规范体系、制度建设体系、党内法规体系、法治实施体系、法治保障体系及法治监督体系等方面提出对策建议。The construction of rule of law in medical institutions still faces more challenges,such as the awareness of rule of law among managers of medical institutions needs to be improved,the development of decision-making and operation according to law is still unbalanced,and the ability to promote the development of medical institutions and resolve disputes according to the law still needs to be strengthened.The authors conducted a questionnaire survey on managers of 67 medical institutions,2,956 medical personnel,and 9,787 staff members of health administration authorities in China by means of questionnaires and expert interviews in order to understand the current situation of rule of law construction in medical institutions across the country and to explore the shortcomings of rule of law construction in medical institutions in terms of top-level design,institutional mechanism,and degree of attention.On this basis,countermeasures were proposed in terms of clarifying the connotation of rule of law construction in hospitals and improving the system of legal norms,the system of system construction,system of party regulations,the system of rule of law implementation,the system of rule of law guarantee and system of rule of law supervision.
