摘  要:互联网平台用工的"灵活性"特征对现行法律规制提出了挑战,主要体现为"难以纳入现行劳动关系范畴"和"职业伤害风险难以保障"。事实上,对于平台用工而言,判定劳动关系的最终目的是为了解决该行业面临最突出的问题——职业风险保障。纵观我国现阶段各地区实践中的运行模式,包括"工伤保险模式""职业伤害险模式"和"商业保险模式",各有利弊。通过对比借鉴国外的实践经验,在路径选择上,建议构建劳动关系与社会保险的脱钩机制。在立法层面上,建议修改《工伤保险条例》,扩大强制参保范围;秉持独立性原则和多层次原则;合理的设置平台就业者参加工伤保险的缴费机制。The“flexibility”feature of internet platform employment poses a challenge to the current legal regulations,which is mainly reflected in the“difficulty to be included in the current labor relationship category”and“the occupational injury risk is difficult to guarantee”.In fact,for platform employees,the ultimate goal of determining labor relations is to solve the most prominent problem facing the industry-occupational risk protection.Looking at the operating modes in practice in various regions at this stage in my country,including the“work-related injury insurance model”,the“occupational injury insurance model”and the“commercial insurance model”,each has its advantages and disadvantages.By comparing and learning from foreign practical experience,in terms of path selection,it is recommended to build a decoupling mechanism between labor relations and social insurance.At the legislative level,it is recommended to amend the“Work Injury Insurance Regulations”to expand the scope of compulsory insurance;uphold the principle of independence and multi-level principles;reasonably set up a payment mechanism for platform employees to participate in work injury insurance.
