贵州省湿地保护立法探析

摘　　要：贵州湿地保护工作取得了阶段性成果,但湿地立法方面还需进一步加强。由于缺乏上位法指引,贵州省湿地保护法律体系存在法律概念不清、湿地生态补偿制度效果不佳、公众参与制度缺失等方面的内容,阻碍了生态文明建设步伐。《湿地保护法》的颁布给贵州湿地保护带来新契机,以《湿地保护法》为原则,根据贵州省情况调整不适应上位法的内容,适时修改以《贵州省湿地保护条例》为代表的其他配套法律规定,努力打造美丽贵州、生态贵州。Wetland protection in Guizhou has made periodic achievements,however,the wetland legislation needs to be further strengthened.Due to the lack of superior law for the legislation for wetland protection in Guizhou Province,legal concepts are not clear,and the effect of ecological compensation is not good,lack of policies on public participation,which hinder the pace of ecological civilization construction.The promulgation of the Wetland Protection Law brings a new opportunity for wetland protection in Guizhou.The Wetland Protection Law should be taken as the principle,those are not consistence with the superior law should be adjusted according to the provincial situation,and other relevant laws and regulations represented by the Guizhou Wetland Protection Regulations should be amended in due course,in an effort to create a beautiful Guizhou and an ecological Guizhou.
