“角色混乱”:村(居)法律顾问制度的运行困境——以广东省G市为例

摘　　要：作为基层法治和公共法律服务体系的关键抓手,村(居)法律顾问制度遭遇诸多挑战。在村(居)法律顾问制度实践中,除了制度建设之外,还应该关注村(居)法律顾问这一关键行动者。在广东省G市,村(居)法律顾问制度运行成效不彰的原因在于村(居)法律顾问陷入了“角色混乱”,体现在“角色冲突”“角色妥协”与“角色失范”三个层面。“角色混乱”困境从根本上源于村(居)法律顾问制度逻辑的内在紧张性、国家“送法下乡”与基层“迎法下乡”的张力以及担任村(居)法律顾问的律师个体因素。因此,要使村(居)法律顾问制度运行有效,必须重视制度与行动者之间的互嵌,在优化制度设计的基础上简化村(居)法律顾问的“角色”并增强村(居)民的法治获得感和认同度。In the practice of the village(resident)legal counsel system,we should also pay attention to the village(resident)legal counsel as a key actor in addition to system construction.Based on the observation of village(neighborhood)legal counsel in G City,Guangdong Province,this paper finds why village(neighborhood)legal counsel is difficult to act effectively lies in“role confusion”,which is embodied in three aspects of“role conflict”,“role compromise”and“role anomie”.The dilemma of“role confusion”is fundamentally derived from the internal tension of the logic of the village(resident)legal adviser system,the tension between the state“sending the law to the countryside”and the grassroots“welcoming law to the countryside”,and the bounded rationality of lawyers serving as village(resident)legal counsel.Therefore,in order to make the village(residential)legal counsel system run effectively,we must pay attention to the mutual embedding between the system and actors,which can simplify the“role”of village(resident)legal counsel and enhance the sense of gain and recognition of village(resident).
