摘 要:【目的】解决新业态下他人将互联网企业商标用于互联网企业未注册的商品或服务类别之上而引发的商标纠纷。【方法】通过梳理相关案例,结合驰名商标跨类保护的法律法规等,对商标授权确权实践中互联网企业驰名商标的跨类保护进行探析。【结果】相关案例表明,商标授权确权实践中,更多的是在考虑知名度的同时,对商标使用的持续时间与具体的年限灵活考量;互联网企业驰名商标跨类保护限于与其有相当程度关联的类别的保护。【结论】对于互联网企业强知名度状态的商标,在持续使用的前提下,应不拘泥于具体的年限要求,综合驰名商标考量因素后对其进行跨类保护,以平衡好互联网企业与传统企业、平台经济与实体经济商标保护的关系。[Purposes]In order to solve the trademark disputes caused by others'use of internet enter⁃prise trademarks for unregistered goods or service categories of internet enterprises under the new busi⁃ness model.[Methods]By combing the relevant cases,and the laws and regulations on the cross category protection of well-known trademarks,research on the cross category protection of well-known trade⁃marks of Internet enterprises in the practice of trademark authorization and confirmation was conducted.[Findings]Relevant cases show that in the practice of trademark authorization and confirmation,it is more flexible to consider the duration and specific years of trademark use while considering the popular⁃ity.The cross category protection of well-known trademarks of internet enterprises is limited to the pro⁃tection of the categories related to them to a certain extent.[Conclusions]Under the premise of continu⁃ous use,the trademark with strong popularity status of internet enterprises should be protected in differ⁃ent categories after considering the factors of well-known trademark,in order to balance the relationship between Internet enterprises and traditional enterprises,platform economy and real economy trademark protection.
