基于责任规则的政府应急征用补偿制度完善研究

摘　　要：应急征用适用责任规则使相对人的交易权和议价能力大幅度减弱,继续沿用建立在财产规则基础上的一般行政征用补偿模式无法满足相对人权利保护的需求。为了确保不同层级、不同类别的行政主体在履行其相应的应急征用权时,以统一的标准、方式和程序履行职能,必须结合责任规则的规范意涵和应急征用补偿制度实践中暴露的立法缺陷,重新解读公平合理补偿原则,将补偿范围从直接损失扩大到间接损失,针对劳务征用特殊的人身损害风险设定更高的补偿标准,以及强化征用补偿的程序控制,推进应急行政权力在法治轨道上良序运转。The application of“liability rules”to emergency requisition has greatly weakened the trading rights and bargaining power of the counterpart,and the continued use of the general administrative requisition compensation model based on“property rule”cannot meet the needs of the protection of the rights of the counterpart.To ensure that administrative subjects of different levels and categories perform their functions in a unified standard,manner and procedure when performing their corresponding emergency requisition rights,we should reinterpret the compensating principle based on“justice and equity”in light of the normative meaning of the“liability rules”and the legislative defects exposed in the practice of the compensation system for emergency requisition.,expand the scope of compensation from direct loss to indirect loss,set a higher compensation standard for the special personal injury risk of labor requisition,and strengthen the procedural control of requisition compensation,thus promoting the orderly operation of emergency administrative power on the track of the rule of law.
