摘　　要：随着互联网技术与平台经济的交融发展,新产业、新业态、新模式经济下的劳动群体日益壮大。实证研究表明,当前新业态劳动关系因不完全符合传统劳动认定标准和民法上雇佣关系的特征而游离于现有的传统法律体系。再加上政府劳动监察与市场监管缺位、用人单位合规审查与自我监管不足等因素,新业态劳动者社会保障权责任划分不明确。建议完善劳动法律体系,推动新业态劳动立法,促进政府积极履行服务监管职能,加强社会综合保障机制建设。With the integration and development of Internet technology and platform economy,labor groups in new industries,new business forms and new model economy are growing in scale day by day.Empirical studies show that labor relations in the new industries are outside of the existing traditional legal system because they do not fully conform to the traditional labor identification standards and the characteristics of employment relations in civil law.In addition,due to the absence of government labor supervision and market regulation and the lack of compliance review by employers and self-regulation of employers,the division of social security rights and responsibilities of the workers in the new industries is not clear.This study suggest improving the labor legal system,promoting labor legislation for new forms of labor,promoting the government’s active performing of its function of service supervision,and strengthening the construction of a comprehensive social security mechanism.
