青海生态文明法治现状及实践路径研究

摘　　要：基于青海省生态环境治理体系和治理能力现代化建设的立场,本文针对青海省生态法文化伦理观、青海省生物多样性保护以及生态补偿机制进行了研究,试图厘清现阶段青海省在运用法律手段推进生态环境治理过程中所存在的问题。这些问题主要体现为:青海省水环境质量、空气质量整体呈现向好的趋势但仍有不足;功利性人本主义思想依然浓厚,人类中心主义价值观占主导地位;地方环境立法供给不足,特别是生物多样性保护法律制度供给不足及生态环境补偿机制立法供给尚待完善;环境公益诉讼数量偏低、环境诉讼成本过高以及环境诉讼犯罪收益认定困难等问题凸显;执法部门执法力度尚待加强、生态环境执法有欠规范。在全面依法治国的宏观背景下,运用法律手段解决上述问题是青海省提升生态环境治理体系和治理能力现代化水平的当务之急。Based on the position of modernizing the ecological environmental governance system and governance capacity in Qinghai Province,this paper studies the ethical view of ecological law and culture,biodiversity protection and ecological compensation mechanism in Qinghai Province,and tries to clarify the problems in the process of using legal means to promote ecological environmental governance in Qinghai Province at the present stage.These problems are:the overall trend of water and air quality in Qinghai Province is improving,but there are still shortcomings;utilitarian humanism is still strong and anthropocentric values dominate;the supply of local environmental legislation is insufficient,especially the supply of legal system for biodiversity protection and the supply of legislation for ecological compensation mechanism is yet to be improved;the number of environmental public interest litigation is low,the cost of environmental litigation is too high,and the revenue from environmental litigation is too high.The number of environmental public interest litigation is low,the cost of environmental litigation is too high,and it is difficult to identify the proceeds of environmental litigation;law enforcement departments need to strengthen law enforcement,and ecological and environmental law enforcement is not standardized.In the context of the overall rule of law,it is imperative to use legal means to solve the above problems in order to improve the modernization of ecological and environmental governance system and governance capacity in Qinghai Province.
