看守所场域中被羁押者通信的审查标准

摘　　要：建构看守所场域中被羁押者与外界通信的审查标准是推动被羁押者通信权从应然走向实然的必要条件。该审查标准建构需要考虑现行规范及对其具有重大影响的内在约束因素,它由实质性标准、操作性标准、形式性标准三部分构成。实质性标准为被羁押者与外界通信的内容应依双方的法律关系确定。操作性标准厘定了审查通信需要把握案件事实,妨碍侦查、起诉、审判,通信对象与通信禁止对象竞合的行动选择,通信的审查频率,看守所安全等内容。形式性标准明确了辩护律师向被羁押者发出的信件采用“拆而不阅”并抖动的方式,被羁押者向辩护律师发出的信件采用拆阅且仅审查是否妨碍看守所安全的内容;被羁押者与一般辩护人、近亲属、有信誉的朋友、一般亲属的通信采用拆阅的审查方式。The construction of a standard for the review of detainees'communications with the outside world in the custodial setting is a necessary condition for promoting the detainees'right to communicate from what should be to what is.It consists of three parts:substantive,operational,and formal standards.The substantive standard is that the content of the detainee's communication with the outside world should be determined by the legal relationship between the two parties.The operational standard defines the need to review communications to grasp the facts of the case,obstruction of investigation,prosecution and trial,the choice of action between the object of communication and the object of communication prohibition,the frequency of review of communications,and the security of the detention center.The formal standards clarify that letters sent by defense attorneys to detainees are to be opened but not read,and that letters sent by detainees to defense attorneys are to be opened and read only to examine whether they interfere with the security of the detention center;communications between detainees and general defenders,close relatives,reputable friends,and general relatives are to be opened and read.Correspondence between detainees and general defenders,close relatives,friends in good standing,and relatives in general is reviewed.
