破产劳动债权实现的研究——以构建全国性欠薪保障基金为切入点

摘　　要：随着国际局势日益紧张等因素导致我国市场经济低迷,破产企业数量持续增加,劳动者失业后还可能面临无法获得工资保障的困境。现行法律制度下,清偿破产劳动债权主要依赖破产财产,但实践中因客观原因导致欠薪无法被清偿的现象日益凸显。为保障破产劳动债权得到充分实现,立足我国国情,探索多元化保障路径,分析建立全国性欠薪保障基金的必要性和可行性,提出我国欠薪保障基金在立法模式、适用对象、资金征集和偿付原则方面的完善建议,以强化对破产企业职工劳动债权的保障。With factors such as the increasingly tense international situation leading to the downturn of China's market economy,the number of bankrupt enterprises continues to increase,and workers may also face the plight of being unable to obtain wage protection after losing their jobs.Under the current legal system,the settlement of labor claims in bankruptcy mainly relies on the bankruptcy estate,but in practice,the phenomenon that unpaid wages cannot be settled due to objective reasons is becoming more and more prominent.In order to guarantee the full realization of labor claims in bankruptcy,we analyze the necessity and feasibility of establishing a national protection fund for unpaid wages based on China's national conditions,and propose suggestions for improving the legislative model,applicable objects,fund collection and repayment principles of China's protection fund for unpaid wages,so as to strengthen the protection of labor claims of employees in bankruptcy enterprises.
