个人信息获取行为的刑法教义学重塑——二元规制路径的构建

摘　　要：个人信息获取行为应被界分为“生成行为”及“收集行为”。由于现行刑法中涉及的个人信息属性为个人信息本体与载体的集合,这使得仅就收集行为进行评价的一元规制路径对于生成行为规制目的落空。对收集行为规制过程中亦存在解释论路径上的偏差,造成现行刑法因理论构造上的失范,且其与个人信息获取行为之间产生了较大间隙。应当构建“生成”与“收集”并举防控的二元规制路径。对于生成行为规制之缺失应当通过“溢出保护法益目的犯”进行理论填补,而对于收集行为中“其他方法获取个人信息”的理解应当以实质解释论为范式,并建立起递进式的入罪体系标准,从“非法”“与窃取相当的违法性”以及“滋生后续犯罪的可能性”三个维度限缩其可罚性范围。Personal information acquisition behavior should be divided into"generation behavior"and"collection behavior".Because the personal information attribute involved in the current criminal law is the collection of personal information ontology and carrier,this makes the unitary regulatory path of only evaluating collection behavior fail to meet the regulatory purpose of generation behavior.There is also a deviation in the interpretation path in the process of regulating the collection behavior,resulting in a large gap between the current criminal law and the acquisition of personal information due to the theoretical structure of the anomie.We should build a dualistic regulatory path of"generation"and"collection"to prevent and control.The lack of regulation of generation behavior should be filled by the theory of"overflow protection of legal interest purpose crime",and the understanding of"other methods to obtain personal information"in the collection behavior should take the substantive interpretation theory as the paradigm,and establish a progressive standard of criminalization system,From the three dimensions of"illegality","illegality equivalent to theft"and"possibility of breeding subsequent crimes",the scope of its punishment is limited.
