论智能司法促进营商环境优化的挑战及建议

摘　　要：智能司法时代的到来,推动了司法效率和司法公正的提升,给法律领域带来新的变化和发展。营商环境体现着一个国家或地区经济发展软实力,是经济高质量发展的重要推动因素。根据世界银行营商环境评估方法,司法的智能化程度是评估营商环境的重要指标之一,对优化营商环境具有显著促进作用。但在此过程中,智能司法也面临着算法技术局限,安全保障技术滞后,数据储备不足和复合型人才缺乏的自身挑战。因此,通过完善相关法律法规、建立司法数据开放共享平台、开发信息防护系统和培养复合型人才等措施,提高司法智能化水平,推动司法系统的变革和发展,以优化营商环境建设。The advent of the era of intelligent justice has promoted the improvement of judicial effi⁃ciency and judicial justice,bringing new changes and development to the legal field.The business envi⁃ronment reflects the soft power of a country’s or a region's economic development and is an important driving factor for high-quality economic development.According to the World Bank's assessment meth⁃od of business environment,the degree of judicial intelligence is one of the important indicators to eval⁃uate the business environment,which has a significant role in optimizing the business environment.However,in this process,intelligent justice is also faced with the challenges of limitations of algorithm technology,lagging of security guarantee technology,insufficiency of data reserve and lack of inter-disci⁃plinary talents.Therefore,by improving relevant laws and regulations,establishing the opening and shar⁃ing platform of judicial data,developing information-protecting system,cultivating inter-disciplinary tal⁃ents and other measures,we can improve the level of judicial intelligence,promote the reform and de⁃velopment of the judicial system,so as to optimize the construction of business environment.
