论作为社会法价值理念的关怀伦理

摘　　要：当代女性主义者从女性道德思维的特殊性出发,提出了与正义伦理相对应的关怀伦理。正义伦理强调个人的理性自主,处理问题有普遍化的倾向,关怀伦理则要求考虑情境的具体性和特殊性,注重人与人之间的情感、责任以及相互关怀。关怀伦理与社会法的价值理念是高度契合的,这体现在社会法的产生逻辑、立法目的、法律原则、调整方法等诸方面,也体现于传统私法规范的社会法化现象中。以关怀伦理为指引,社会法的调整对象将持续地去标准化,这也为社会法的法典化带来诸多挑战,社会法上的争议解决将社会工作化。正如社会法对传统公私二元法律体系产生的冲击一样,关怀伦理的法学应用也将改变法治的未来面貌。Inspired by the particularity of women’s moral thinking,contemporary feminists advanced a new ethics of care over the traditional ethics of justice.Ethics of justice values the individual rationality and shows a universalized tendency in solving issues.Conversely,ethics of care values the situation’s concreteness and particularity,and it pays more attention to the emotion,responsibility and care between people.Whether from the generating logic of social law,the legislative purposes of social law,the basic principles of social law,the adjustment methods of social law,or from the socialization of traditional private law,there is a high degree of consistency between ethics of care and the basic values of social law.Guided by ethics of care,the adjusted objects of social law will continue to be de-standardized.This also brings many challenges to the codification of social law.In addition,the settlement of dispute in social law will increasingly use methods of social work.Just like the impact of social law on the traditional public-private dual legal system,the legal application of ethics of care will also change the future picture of the rule of law.
