电信网络诈骗犯罪侦查中冻结措施运用存在的问题及其解决路径——以法律规制为视角

摘　　要：冻结措施的运用有利于阻止涉案资产的转移、固定案件证据。在侦查实践中,多数侦查人员能够按照法律的要求开展冻结工作。但不可否认的是,一些侦查人员在运用冻结措施时还存在一些明显的问题,一是不当扩大冻结的范围,二是没有严格控制冻结的期限,三是实施冻结与解除冻结程序不规范。其原因主要有冻结范围和期限的法律规定不够明确、冻结程序和职权行为的法律规制存在不足等。因此,应当完善冻结措施运用的规范体系,通过比例原则来约束冻结范围的扩张,引入诉权机制,保障当事人知情权,以实现冻结程序的规范化。The application of freezing measures is conducive to preventing the transfer of case-involved assets and fix-ing the evidence.Most investigators can carry out freezing work according to the requirements of law in the practice.But it is undeniable that there are still some obvious problems including improper expansion of freezing scope,undemanding control of freezing period,and nonstandard implementation procedures.The main reasons are not clear legal provisions on freezing scope or duration and insufficient legal regulations on freezing procedures or authority.Therefore,the standard system of freezing measures should be improved,the expansion of freezing scope should be restricted through the principle of propor-tion,and the litigation mechanism should be introduced so as to protect the parties'right to know and achieve the normal-ization of freezing procedures.
