数据要素流通的制度逻辑

摘　　要：数据是数字经济的关键生产要素,数据流通制度是数据要素制度的核心内容。数据流通制度由正式规则和非正式规则组成,正式规则包括数据流通准入规则、数据资产估值定价规则、数据交易规则、数据流通中介规则、数据流通治理规则等,价值信念、惯例、文化传统、道德伦理、意识形态等非正式规则也是影响数据流通的重要制度。数据要素流通的非正式规则与正式规则存在替代、互补和相容的关系,两种规则兼容而非冲突,会提高数据流通的有效性和适应性。建立健全数据流通规则,需要建立正式规则与非正式规则相融合的规则体系,发挥非正式规则的规范功能和激励功能,实现数据要素安全高效流通。Data is the key production factor of the digital economy,and the data flow system is the core of the data factor system.The data circulation system consists of formal rules and informal rules.Formal rules include data classification rules,data trading rules,data use rules,and data asset valuation and pricing rules.Informal rules such as value beliefs,practices,cultural traditions,morals and ethics,and ideologies are also important institutions that influence data circulation.Informal rules of data elements circulation and formal rules have alternative,complementary and compatible relationships,and the two rules are compatible rather than conflicting,so that data circulation will show effectiveness and adaptability.The establishment of sound data circulation rules requires the establishment of a rule system that integrates formal rules and informal rules,and gives play to the normative function and incentive function of informal rules to finally realize the safe and efficient circulation of data elements.
