摘　　要：法治思想是实现规划法治化的重要基础和前提。为探讨国土空间规划体系转型中详细规划的法治化建设问题,对“以法”管制与“依法”规制的法治思想进行辨析,从权力、权利与法律的关系层面,深入剖析我国控规既往“以法管制”的规划实施困境。针对国土空间规划体系中详细规划的目标与地位,提出“用途规制分区”在国土空间详细规划中应用的可能性,并阐明国土空间详细规划从“管制”向“规制”转型的必要性。The idea of the rule of law isan important foundation and prerequisite for realizing theruleof law inplanning.In order to discuss the rule of law of detailed planning during the transformation of the territorial planning system,this paper analyzes the differences between"rule by law"and"rule of law".Then from the perspective of the relationship between power,right,and law,the paper conducts an in-depth exploration on the"rule by law"implementation dilemma of previous regulatory planning.In view of the goal and status of territorial detailed planning,it fully demonstrates the possibility of applying"land use regulation zoning"in territorial detailed planning,and clarifies the necessity of the transformation of territorial detailed planning from"control"to"regulation".
