预防监狱民警职务犯罪的思考

摘　　要：职务犯罪是一种复杂且隐蔽性极强的犯罪类型。职务犯罪的认定尤其是监狱民警职务犯罪的问题,牵涉到宪法、刑法、民法、监狱法、行政法等多部法律,以及“两高三部”发布的各项条例。职务犯罪与职务行为活动交织在一起,使得犯罪认定工作推进阻力增大,许多问题亟待从理论上深入研究并在实践中加以解决。At present,duty-related crimes are very prominent.It is the duty of the procuratorial organ to unswervingly promote the reform of the judicial system and crack down on duty-related crimes.Duty crime is a complex and highly covert crime type.The identification of duty crime,especially the issue of prison police duty crime,involves many laws such as the Constitution,the Criminal Law,the Civil Law,the Prison Law,the Administrative Law,and various regulations issued by the two senior departments and the three departments.The combination of duty crime and duty behavior activities increases the resistance to the promotion of crime identification,and many problems need to be studied in theory and solved in practice.Based on the typical cases of duty crime of prison police,this paper analyzes the causes and characteristics of duty crime of prison police in China and puts forward some feasible countermeasures.
