摘　　要：新冠肺炎疫情防控中,新冠肺炎疫情防控指挥部发挥了不可替代的作用,其成立的法律依据为《突发事件应对法》。新冠肺炎疫情防控指挥部的行政法律地位相当于法律法规授权的组织,作出“封城”、全域静态管理、封控等涉及限制公民行动自由的决定机关应该依法由决定权机关做出或者由有权机关明确授权疫情防控指挥部作出决定。应根据疫情防控实践经验,进一步完善有关法律及进一步依法规范疫情防控措施,以促进法治政府、法治国家建设。In the prevention and control of COVID-19,the Epidemic Prevention and Control Headquarters has played an irreplaceable role.The legal basis for its establishment is the Emergency Response Law.The administrative legal status of the Epidemic Prevention and Control Headquarters are equivalent to the organization authorized by laws and regulations,which has made the city closed,global static management The decisions concerning the restriction of citizens'freedom of movement,such as closure and control,should be made by the competent authority according to law or by the epidemic prevention and control headquarters explicitly authorized by the competent authority.The practical experience of epidemic prevention and control shows that China needs to further improve relevant laws and standardize epidemic prevention and control measures in accordance with the law to promote the construction of a government and a country ruled by law.
