摘 要:广东省“三旧”改造为促进节约集约用地,助力粤港澳大湾区打造世界级城市群做出了重要贡献。但是,在改造过程中,由于不同利益主体的诉求不同,存在一小部分人拒不搬迁,成为留守户,动迁难成为“三旧”改造项目推进中的难点和痛点。现行法律体系中,“三旧”改造动迁与征收动迁有着本质的区别,“三旧”改造动迁具有市场化属性,对留守户缺乏强有力的法律手段。如何才能在法律的框架下多渠道推动解决“三旧”改造动迁纠纷?实践中解决路径存在哪些障碍和争议?结合实际案例进行深度分析并提出解决问题的建议。The“three old”transformation in Guangdong Province has made an important contribution to promoting the conservation and intensive use of land and helping the Greater Bay Area of Guangdong,Hong Kong and Macao to build a world-class urban agglomeration.However,in the process of reconstruction,due to the different demands of different stakeholders,there will always be a small number of people who refuse to move and become left-behind households.The difficulty of moving has become the difficulty and pain point in the promotion of the“three old”reconstruction project.In the current legal system,there is an essential difference between the“three old”transformation and the expropriation and relocation.The“three old”transformation and relocation has the market attribute,and lacks strong legal means for the left-behind households.How can we promote the settlement of the“three old”reconstruction and relocation disputes in multiple channels under the legal framework,and what obstacles and disputes exist in the solution path in practice,combined with actual cases to conduct in-depth analysis and put forward suggestions to solve the problems.
