政策评估视角下的公平竞争多元审查机制

摘　　要：公平竞争审查制度是维护市场公平竞争的重要制度。中国现行采用的内部审查制限制了公平竞争审查制度的作用,难以完全发挥其设计初衷。为了追求审查实效性,公平竞争审查需要兼具文本审查和合理性审查,合理性审查成为深入审查进路的关键。实务和理论界给出了公平竞争审查制度的诸多潜在调整方案,各具利弊。公平竞争多元审查机制不仅整合了政策制定部门内部审查和竞争主管机构的审查监督评估等机制,更充分考虑中国公平竞争审查第三方评估机制的成熟经验,在将政策按照影响范围、政策等级等标准进行分级的基础上,将多元社会力量引入审查机制中。公平竞争多元审查机制符合新时代社会治理理念转型的现实要求,满足公平竞争审查制度创新的各项需求。The fair competition review system(FCRS)is a fundamental system constructed to maintain fair competition in the market.However,it is potentially limited by the current internal review system and thus difficult to fully realize the original design intention.To deal with the problem,the fair competition review should include both a text review and a rationality review,among which the rationality review is the key to the in-depth review and competition assessment of policies.At present,there is an amount of discussion for FCRS adjustment from practical and theoretical perspectives.We suggest that the multi-agent fair competition review system not only absorbs the internal review of policy-making departments as well as the review,supervision and assessment of competition authorities but also fully considers the mature experience of the third-party evaluation mechanism of the FCRS.It introduces the multi-agent social forces into the review system based on the grading policies according to the scope of influence,policy level and other standards.The multi-agent fair competition review system conforms to the practical requirements of the social governance transformation in the new era and fits the innovation of the fair competition review system.
