新时期国际经贸规则变革的国际法理论问题

摘　　要：以世界百年未有之大变局的历史视野来观察,国际经贸规则发展与改革的历史脉络、目标、宗旨、动力、路径,及其所依托的理论基础都在发生着深刻变化,国际经贸规则的变革朝着更加公平、公正与合理的方向前进成为历史的必然,多边舞台应当成为国际经贸规则发展与变革的主渠道,对当前个别发达国家采取单边行动冲击、损害和影响国际经贸规则的各种迹象应予以高度关注;在坚持多边主义、维护多边贸易体制核心地位的同时,中国与广大发展中国家应积极运用“一带一路”倡议、双边和区域贸易合作机制,主动推进建设“公平、公正与合理”的国际经贸规则的实践进程。在回顾和反思以往国际政治、经济、法律理论的基础上,尝试提出具有东方思想色彩的“新自然法理念”、“基于大陆法传统的实证主义国际法学”、“实践人类命运共同体的集体主义国际法学”、“围绕人类共同命运的新历史主义国际法学”和“比较国际法学”的初步理论构想,以促进学术交流、为人类和平与发展事业作出贡献。This paper,in the perspective of the great historical changes unseen hitherto in a century,probes into the historical origin,goal,purpose,motive force and path of the development and reform of international economic and trade rules,based on the theoretical basis of international politics,economics and law.It demonstrates that the reform of international economic and trade rules is going towards a much equitable,just and reasonable direction,and is the just cause of human development.It points out that multilateralism is the main channel of the development and reform of international economic and trade rules and that a great attention should be paid to the signs that a few major economies have taken unilateral actions to damage and influence international economic and trade rules.While upholding multilateralism and maintaining the central position of the multilateral trading system,China and other developing countries should make active use of the"Belt and Road"initiative and bilateral and regional trade cooperation mechanisms to promote actively the practice of constructing"equitable,just and reasonable"international economic and trade rules.On the basis of reviewing and reflecting past theories,this paper attempts to explore on"New Ideas of Natural Law"which absorbs oriental thoughts,Positivism international law based on the Civil Law Tradition","Collectivism-centered International Law on the practice of the Community of Human Destiny","New Historicism International Law on the Community of Human Destiny"and"Comparative International Law",to promote academic exchanges and contribute to the cause of peace and development of mankind.
