摘　　要：网络证据是专利法意义上的“出版物”的具体形式之一。随着科技的不断发展,越来越多的现有技术已经在通过网络的方式进行传播。对抖音等视频软件检索在专利审查中的应用进行浅析,并提出一种全新的检索思路,结合两个具体案例说明如何利用抖音提高检索效率,获得可以评价本申请新创性的对比文件。Network evidence is one of the specific forms of“publications”in the sense of the Patent Law.With the development of technology,more and more existing technology have been spread through the Internet.This article proposes a new search idea to analyze the method of searching in video software such as TikTok in patent examination,and two specific cases are combined to illustrate how to use TikTok to improve search efficiency and obtain comparative documents that can evaluate the novelty of the patent application.
