摘　　要：《刑法修正案(十一)》增加了保护野生动物的相关条款,对以食用为目的的非法猎捕、收购、运输、出售陆生野生动物的违法犯罪行为进行了规制。但是我国刑法在野生动物保护方面仍不完善,存在野生动物保护范围有待进一步拓宽、破坏野生动物栖息地行为亟需刑法规制、刑罚规制体系有待进一步完善、滥食野生动物的相关罪名有待补充等问题。为建立健全体系完备、系统协调的野生动物刑法保护体系,进一步维护生态安全,促进人与自然和谐共生,我国现阶段需要对野生动物的保护范围适度扩大化、破坏野生动物栖息地相关罪名明确化、破坏野生动物犯罪刑罚体系规范化、非法食用野生动物等相关行为入刑化等方面加以完善。Amendment(Ⅺ)to the Criminal Law of the People's Republic of China has added provisions for the protection of wild animals and regulates the illegal hunting,acqui⁃sition,transportation,and sale of terrestrial wild animals for the purpose of consumption.However,the criminal law of China is still imperfect in the aspect of wild animals protec⁃tion.There are problems such as the scope of wild animals protection needs to be further expanded,the behavior of destroying wild animals habitat needs to be urgently regulated by criminal law,the penal regulation system needs to be further improved,and the related charges of eating wild animals need to be supplemented.China needs to expand the scope of wild animals protection,clarify the crimes related to destroying wild animals habitats,standardize the criminal penalty system for wild animals crimes,criminalize the illegal consumption of wild animals,and other measures to establish a complete,systematic and co⁃ordinated criminal law protection system for wild animals,further maintain ecological security and promote the harmonious coexistence between human beings and nature.
