反对外部势力干涉中国台湾问题的话语体系初论——以一个中国原则的话语构建为主轴

摘　　要：一个中国原则是中国政府和中国人民反对外部势力干涉中国台湾问题的核心法理依据。围绕一个中国原则的事实基础,关于“台湾是中国领土一部分”的结论形成了以国际法为主要依托,涵盖“自古以来”“中国台湾光复”和“普遍承认”三重逻辑的话语表达。在国家实力、斗争策略和法理依据三个要素的作用下,一个中国原则的国际法话语表达发挥了卓著成效,但面对“台独”论述与干涉论述复合形成的“内源性话语解构”论述造成的现实困境,传统话语表达的回应尚不充分。对此,应通过诉诸中国人民的内部权威和中国的国内法资源,尤其是宪法资源,进行一个中国原则的“内源性话语建构”,以补强一个中国原则的国际法话语表达。The One China principle is the core legal basis for the Chinese government and people to oppose external interference in the Taiwan,China question.Focusing on the factual basis of the One China principle,the conclusion that"Taiwan is part of China's territory"has formed a discourse expression based on international law,covering the triple logic of"since ancient times","China Taiwan's restoration"and"universal recognition".Under the influence of the three elements of national strength,struggle strategy,and legal basis,the expression of the One China principle in international law discourse has achieved remarkable results.However,in the face of the practical difficulties caused by"the endogenous discourse deconstruction"discourse formed by the combination of"Taiwan,China independence"discourse and the intervention discourse,the response of traditional discourse expression is not yet sufficient.In this regard,"the endogenous discourse construction"of the One China principle should be carried out by appealing to the internal authority of the Chinese people and China's domestic legal resources,especially constitutional resources,to strengthen the expression of the One China principle in international law discourse.
