摘 要:当事人对于行政机关的行政处罚不服,可以采用申请复议或者诉讼的方式维护自己的权益,在诉讼过程中亦可采取调解的方式以实际解决行政纠纷,终结诉讼程序。行政处罚类行政诉讼调解书涉及罚款事项,但罚款变更的范围、依据、标准等各不相同,如何平衡当事人的处分权和社会公共利益,以及行政机关的自由裁量权和法院的审查权,是多元化实质性化解纠纷不可回避的难题。法院应当审查罚款变更的合法性和自愿性,对于降幅超出法定范围的不予认可。对于涉及重大公共利益的,法院应当依职权选择公开调解协议。对于罚款金额降幅超过50%以及多次违法受罚的,严格审查。If the parties are dissatisfied with the administrative punishment imposed by the administrative organ,they may apply for reconsideration or litigation to protect their rights and interests.During the litigation process,they may also use mediation to actually resolve the administrative dispute and terminate the litigation process.The administrative penalty mediation documents all involve fines,and the scope,basis,and standard of the modification of the fines are different.How to balance the disposition right of the parties and the public interest,as well as the discretionary power of the administrative organ and the review power of the court,is an unavoidable problem in resolving disputes in a diversified substantive manner.The court should review the legality and voluntary nature of the change in fines,and disapprove of the reduction beyond the statutory range.For cases involving major public interests,the court may choose to disclose the mediation agreement.Strict scrutiny will be given to those with a drop of more than 50%and repeated violations of the law.
