未成年人检察民事公益诉讼问题探析

摘　　要：《中华人民共和国未成年人保护法》的颁行促生了未成年人保护检察民事公益诉讼的格局,但其刚刚起步,在实践中存在诸多问题,比如检察机关诉前获取线索调取证据难,诉前程序作用有限,诉中调解制度适用模糊,举证责任分配规则适用不适应,诉后保护救济困难等。检察民事公益诉讼于未成年人保护具有独特价值,须确立蕴含其独立品格的诉讼程序,具体应从诉前、诉中、诉后三个层面予以完善:在诉前,要增设检察机关线索发现渠道并强化调查核实权的内部刚性及重塑诉前程序;在诉中,调解机制的“松紧”与“谁主张谁举证”原则下的新明确;在诉后,确立合适的未成年人权益保护监督者给予未成年人持续的保护和救济。The entry into force of the Law on the Protection of Minors and judicial practice have resulted in the pattern of civil public interest litigation for the protection of minors,but it has just started,and there are still many problems in practice,For example,it is difficult for procuratorial organs to obtain clues and evidence before litigation,and the role of its pre-litigation procedure is limited;The application of mediation system in litigation is also vague,and the application of the distribution rules of burden of proof is not suitable;After litigation,they will also face difficulties in protection and relief.Procuratorial civil public interest litigation has unique value in the protection of minors,and it is necessary to establish a litigation procedure that contains its independent character.It should be improved from three aspects of pre-litigation,litigation and post-litigation.Before litigation,it is necessary to add channels for the procuratorial organs to find clues,strengthen the internal rigidity of the power of investigation and verification,and reshape the pre-litigation procedure.In litigation,mediate the tightness of mechanism and make new clarity under the principle of“who advocates,who gives evidence”.After the litigation,the appropriate supervisor of the protection of minors’rights and interests should be established to give minors continuous protection and relief.
