摘　　要：【目的】全国农业综合行政执法实施数年以来成效如何,是否存在一些问题以及未来重点改进方向等,需要从农业行政执法一线实证研究获知。【方法】结合示范单位或示范窗口农业行政执法评估指标要求,通过实地考察、问卷调查和持续监测,对Z省5地农业综合行政执法情况,包括组织领导、执法机构与队伍建设、支撑保障、规范执法、执法成效等进行了研究。【结果】发现Z省5地农业行政执法比较规范、总体执法水平比较高、执法成效显著,但也存在执法队伍年龄结构不合理、自由裁量权和执法不太规范、极少数执法人员存在执法态度强硬或冷淡等现象。【结论】通过时间发展可以解决执法队伍老龄化问题;通过裁量权规范指引、类案指导等可以一定程度上减少自由裁量权和执法不太规范问题;执法队伍素养的提升则是一个更为长期系统工程。跨区域农业行政执法和执法监督是中国农业行政执法今后重点着力方向。How effective the implementation of agricultural administrative law enforcement(AALE)in China which has been put into effect for several years,and whether there are some existing problems or improvements in the future,need to be learned from the empirical research.Using the evaluation index requirements of AALE and through the methods of on-the-spot investigation,questionnaire survey and continuous monitoring,this article studied the implementation of AALE in the chosen five places of Z province,including organization and leadership,law enforcement agencies and its teams,support system,standardization of law enforcement,and effectiveness of law enforcement,etc.The article found that the AALE of the chosen five places in Z province which are demonstration units or windows was relatively standardized,was on high levels on the whole,and had remarkable effects.However,there were some problems in the AALE,such as unreasonable age structure of the law enforcement team,abuse of discretionary power and differential law enforcement,a few officers’tough or indifferent attitudes in law enforcement.The article pointed out that time could solve the first problem;the second problem could be solved to a certain extent through the normative guidance of discretion and the guidance of similar cases;but the improvement of the professional qualities of law-enforcement officers was a long-term systematic project.The cross-regional AALE and law enforcement supervision would be the key points of the AALE in China.
