论市场监管权与综合行政执法权之协调

摘　　要：党的二十大报告提出要强化多个领域的市场监管,同时将优化政府职责体系与深化行政执法体制改革予以明确。市场监管与综合行政执法作为党和国家机构改革后分道重组的两类行政权力,同样需要协调,而其协调首先起步于两类权力所依托的法治保障之间的区别。市场监管权力改革的法治保障呈现系统化趋势,而综合行政执法更多通过“文件”进行权力划转。市场监管与综合行政执法的权力协调首先应考虑进一步组织化、法定化,同时拓展联合监管的适用,并补强市场监管等业务职能部门向综合行政执法部门的权力划转。在此基础上,中央和地方都应进一步通过立法明确各项权力的去留,更深刻关注行政处罚法等新法的内在精神,多层次倒逼各方加强执法保障,实现权力协调在各层面的综合效应。The report of the 20th National Congress of the Communist Party of China not only mentioned the need to strengthen market supervision in multiple fields,but also clarified the need to optimize the government responsibility system and deepen the reform of the administrative law enforcement system.Market supervision and comprehensive administrative law enforcement,as two types of administrative powers that are divided and restructured after the reform of the Party and state institutions,also need to be coordinated,and their coordination starts from the difference between the legal guarantees that the two types of powers rely on.The legal guarantee of the reform of market supervision power presents a systematic trend,while the comprehensive administrative law enforcement transfers power more through “documents”.The power coordination between market supervision and comprehensive administrative law enforcement should first consider further organization and legalization,expand the application of joint supervision,and strengthen the transfer of power from business functional departments such as market supervision to comprehensive administrative law enforcement departments.On this basis,the central and local governments should further clarify the fate of various powers through legislation,pay more attention to the inherent spirit of new laws such as the Administrative Punishment Law,and force all parties to strengthen law enforcement guarantees at multiple levels to achieve the comprehensive effect of power coordination at all levels.
