区块链技术视域下的土地经营权流转

摘　　要：农地“三权分置”中的“放活土地经营权”,在实践中主要表现为土地经营权在“熟人社会”以及在“中介交易平台”上进行流转。虽然“中介交易平台”流转模式具有一定的比较优势,但其在信任基础、交易方式以及监督机制等方面存在明显不足,而利用区块链技术能够实现土地经营权市场化流转从1.0版本到2.0版本的提升。区块链技术在土地经营权市场化流转中的契合性以及“区块链+土地经营权流转”模型的构建表明,区块链技术与土地经营权流转具有妥适性。实现农村土地资产数字化、依托技术构建信任基础以及利用智能合约提高流转效率,是区块链技术应用于土地经营权流转的基础条件;激励机制的内在嵌套、“多中心化”下的监管以及智能合约的漏洞填补,则是实现区块链技术与土地经营权流转现实兼容的实践考量。In practice,the“release of land management rights”in the“three rights of agricultural land”is mainly manifested in the“acquaintance society”and the“intermediary trading platform”for the transfer of land management rights“intermediary trading platform”.Although the“intermediary trading platform”model has certain comparative advantages,it has obvious shortcomings in terms of trust base,transaction method and supervision mechanism,while the use of blockchain technology can improve the market-oriented land management rights transfer from version 1.0 to version 2.0.The suitability of blockchain technology in the market-oriented land management rights transfer and the construction o“f blockchain+land management rights transfer”model show that blockchain technology and land management rights transfer are appropriate.The digitization of rural land assets,the building of trust base based on technology and the use of smart contracts to improve the efficiency of transfer are the basic conditions for the application of blockchain technology to land management rights transfer;the inherent nesting of incentives,the supervision under“polycentricity”and the filling of loopholes of smart contracts are the practical considerations for the compatibility of blockchain technology and land management rights transfer.The nesting of incentive mechanism,supervision under“polycentric”and filling the loopholes of smart contract are the practical considerations to realize the compatibility of blockchain technology and land management rights transfer.
