摘 要:消费者的网络评价权是指消费者在网上购买、体验过商品和服务后,对该商品和服务发表意见、提出看法的权利。消费者网络评价权作为一种新型的权利,在本质上与监督权、表达权存在一定的区别。在电子商务迅速发展的背景下,保护消费者网络评价权具有重要意义。当前,网络交易市场已成为国内市场经济的重要模块,但网络交易评价体系存在的问题也日益凸显,各电商平台自主设计的消费者网络评价体系难以最大限度避免消费者和经营者之间的利益冲突,且由于部分平台监管体系不够完善,缺乏对应的救济手段,平台评价体系的作用难以充分发挥。基于此,本文从权利入法的必要性、方式以及在司法实践中存在的倾向性问题对消费者网络评价权提供了一系列法治化的建议。The right to online evaluation refers to the right of consumers to express their opinions on goods and services that they have purchased online.As a new type of right,it is essentially distinct from the right of supervision and expression.With the rapid advancement of e-commerce,protecting consumers’rights of online evaluation is of great significance.Currently,the online trading market has become a significant part of the market economy,but the issues in the online trading evaluation system are increasingly prominent.The evaluation system independently designed by e-commerce platforms failed to resolve conflicts of interest between consumers and operators,and the role of the system can not be brought into fully play due to imperfect regulatory system of some platforms and the lack of relief measures.In view of this,a series of suggestions are put forward in terms of the necessity and methods of incorporating rights into law,as well as the issues that exist in judicial practice.
