产权改革、利益锁定与乡村治理的能力困境

摘　　要：农村集体产权包含治理与经济双重维度。新一轮农村集体产权制度改革涉及股权量化与“政经分离”两大内容,偏重于经济维度。但这一改革在一些地区所引发的治理问题也需注意,表现为:农民之间出现分化对立,治理主体呈现“二元分治”,治理规则面临公私分化。改革之所以引发这些问题,原因在于塑造了新的集体产权利益分配规则:股权量化通过明确农民与集体产权间更加直接的利益关联,重建了集体产权内部新的利益结构;而“政经分离”通过调整自治规则,将这种利益结构进一步锁定。这二者容易抽离乡村有效治理的资源基础,并使乡村有效治理的规则发生变化,最终导致乡村治理面临能力困境。因此,在推进农村集体产权制度改革、充分释放集体产权经济活力的同时,还需要辅以一定的政策优化与社会自治共同体意识的培育以规避其消极治理效应。Rural collective property rights include the dual dimensions of economy and governance.The current reform of rural collective property rights system focuses on economic dimension,involving equity quantification and"separation of politics and economy".However,some rural governance problems caused by the reform also need to be noted,which are differentiation and opposition between farmers,"dual governance subject"and the public-private differentiation in governance rules.The main reason is it has formulated new rules for the distribution of collective property rights interests.Equity quantification has reconstructed a new interest structure within collective property rights by clarifying the more direct interest relationship between farmers and collective property rights.Furthermore,"separation of politics and economy"locks this interest structure by adjusting the rules of autonomy.The two factors of the reform are liable to withdraw the resource base of effective rural governance,change rules of effective rural governance and lead to current dilemma of rural governance capacity.Therefore,while China is promoting the reform of rural collective property rights system and fully releasing the economic vitality of collective property rights,policy optimization and cultivation of social autonomous community awareness are also needed to avoid the negative governance effects.
