论我国医疗损害鉴定调解制度的构建

摘　　要：医疗损害鉴定调解制度是鉴定人按照司法鉴定程序对医疗纠纷作出鉴定意见,提出调解方案,促使医患双方达成调解协议的一种新型的非诉讼纠纷解决机制。鉴定调解制度具有遵循自愿原则、调解时机的恰当性、查清事实明确责任以及体现权威性的特征。实行鉴定调解制度对于解决医疗信息不对称、提升医疗纠纷处理的效率、增强当事人对鉴定调解机制公正性的认同度具有重要的功效。应当借鉴德国以及我国台湾地区的经验,建立医疗损害鉴定调解制度,确立鉴定调解的基本原则,明确规定鉴定调解程序,强化鉴定调解协议的效力,构建鉴定调解监督制度,为全面推行医疗损害鉴定调解机制提供法律依据。As a new non-litigation dispute resolution mechanism,medical damage identification and mediation system enables the appraiser to put forward the identification opinion on medical disputes in line with the judicial appraisal procedure,put forward a mediation plan,and push the doctors and patients to reach a mediation agreement.The identification and mediation system has the features of following the principle of voluntariness,the appropriateness of the mediation opportunity,getting clear of the facts,clarifying the responsibilities and embodying the authority.The implementation of the identification and mediation system can play a significant role in effectively solving the problem of medical information asymmetry,enhancing the efficiency of handling medical dispute,and strengthening the parties'recognition of the fairness of the identification and mediation mechanism.Based on this,some suggestions are proposed for China,such as the necessity to learn from the experience of Germany and Taiwan,setting up the medical damage identification and mediation system,determining the basic principles of identification and mediation,clarifying the identification and mediation procedure,enhancing the effectiveness of the identification and mediation agreement,constructing the identification and mediation supervision system,and providing the legal basis for the comprehensive implementation of the medical damage identification and mediation mechanism.
