中央地质勘查基金项目合同管理体系的思考

摘　　要：中央地质勘查基金自设立以来,实行“财政预算”“市场运作”管理模式,建立了项目立项、组织实施、权益管理、质量监管、成果管理、权益处置等完整的管理程序和运行体系,首次形成了以投资合同、勘查合同、监理合同为一体的项目合同制管理体系。地质勘查基金合同管理工作贯穿于项目管理全过程,为保障和促进项目运行实施发挥了重要作用。在分析总结中央地质勘查基金合同管理现状的基础上,介绍了中央地质勘查基金合同类型、合同范本制定及合同管理流程,阐述了投资合同具有有偿使用制度创新、不与民争利、保障合作双方权益分配等特点;勘查合同体现了项目管理和监督方面创新的作用;监理合同首创基金项目“法人监理”模式等。但由于地质勘查基金体制新、机制新的特点,合同管理工作中存在合同管理意识不足、合同管理效率偏低、缺乏统筹全面的合同管理制度等问题。结合国内矿产地质勘查合同的管理特征和中央地质勘查基金合同管理现状提出了提高项目合同管理意识、建立合同管理信息化平台、完善合同管理制度等建议。Since its setting up,central geological exploration fund has carried out the management mode of“financial budget”and“market operation”,establishes a complete management procedure and operation system consisting of project initiation,project organization and implementation,equity management,quality supervision,achievements management,equity disposal,and thus formed the project contract management system for the first time,which integrates investment contract,exploration contract,and supervision contract.The contract management of the geological exploration fund runs through the entire process of project management and plays an important role in ensuring and promoting the operation and implementation of the project.Based upon on the analysis and summing up of the current situation of central geological exploration fund contract management,introduces the contract types,the contract model formulation and the contract management process of the central geological exploration fund.It expounds the characteristics of the investment contract,consisting innovation in the compensated use system,not competing with the people for benefits,and ensuring the distribution of the rights and interests of both parties to the contract.The exploration contract embodies the innovative role of project management and supervision.The supervision contract initiates the“legal person supervisor”mode for fund project.Due to the new characteristics of the geological exploration fund system and mechanism,there are some problems in contract management,such as insufficient awareness of contract management,low efficiency of contract management,and lack of comprehensive contract management system.Based on the management characteristics of domestic mineral geological exploration contracts and the current situation of contract management of the central geological exploration fund,puts forward suggestions on improving project contract management awareness,establishing contract management information platform,and perfecting contract manageme
