摘 要:学生参与权作为一项新兴权利,是新时代背景下对受教育权的细化,在推进校园治理与改革、保障学生受教育权方面具有重大意义。然而在现行的立法模式下,学生参与权规范数量不足、体系性弱、操作性差,导致实践中学生的参与权一再被忽视。当前,在教育法典编纂的背景下,学生参与权入典应遵循“区分主体,明晰权责”的指导思想,按照“先总后分”的体例,在系统整合并细化现有规范的基础上增设激励、责任条款,最终构建一个涵盖事前、事中、事后参与的规范体系,形成对教育权利的全面保护。As a new kind of right,the right of student participation is a refinement of the right to education in the context of the new era.It has significant significance in promoting campus governance and reform,and safeguarding students'right to education.However,under the current legislative model,the number of regulations on students'participation rights is insufficient,the system is weak,and the operability is poor,which leads to the repeated neglect of students'participation rights.In the context of the compilation of the Education Code,students'participation rights in the code should follow the principle of"distinguishing subjects and clarifying rights and responsibilities",follow the approach of"first summarizing and then dividing",add incentive and responsibility clauses on the basis of systematic integration and refinement of existing norms,and ultimately construct a normative system that covers pre,during,and post participation,forming a comprehensive protection of education rights.
