农地使用权价格与农地承包经营权流转价格关系研究

摘　　要：通过文献资料法、分析对比法,对农地使用权价格与农地流转价格之间的关系进行了研究。结果表明:与农地使用权对比,农地承包经营权是前者存在的前提,并且具有历史范畴和动态属性,发展到一定阶段,将会消失。非流转情况,农地使用权价格是农地承包经营权价格的表现形式;流转情况,存在农地使用权价格、农地承包经营权价格、农地流转价格等形式,其中农地流转价格是农地承包经营权价格地表现形式。农地使用权价格与农地流转价格取决于地块的用途、使用年限以及各自的价格形成机制等因素。由此得出结论:流转前,农地使用权价格与农地流转价格关系较为复杂,需要具体情况具体分析;流转后,理论上农地使用权价格大于农地流转价格。The paper studies the relationship between the price of agricultural land use right and the price of agricultural land transfer through the methods of literature,analysis and comparison.The results indicate that agricultural land contract right embodies the existence premise of agricultural land use right.Agricultural land contract right is a term with dynamic characteristic and a term of history category,when developing to a certain stage,it will disappear.Agricultural land use right price is the manifestation of agricultural land contract right price in the non-conversion situation.There are three types of prices in the conversion situation:agricultural land use right price,agricultural land contract right price and conversion price of agricultural land contract right.Conversion price of agricultural land contract right is the manifestation of agricultural land contract right price.The main factors affecting agricultural land use right price and conversion price of agricultural land contract right are land use,land use term and pricing mechanism,etc.All the above findings providing the relationship between price of agricultural land use right and conversion price of agricultural land contract right is complex in the non-conversion situation.Theoretically,agricultural land use right price is greater than conversion price of agricultural land contract right in the conversion situation.
