摘　　要：醉酒型危险驾驶罪设立十一年来的法律实施效果存在争议。以法律经济学的视角看,单一注重血液中酒精含量的入罪标准可能导致针对醉酒驾驶的法律制裁效果落入非帕累托改进区。破解有关争议的关键不在于法律制裁的严厉程度,而在于其系统性与合理性。醉驾入刑后,我国醉驾制裁体系至少出现了三个问题影响了其系统性与合理性,即严苛的“血液中酒精浓度值”醉驾测试方法、《道路交通安全法》与《刑法》的行刑衔接真空,以及醉驾制裁体系内生的隐性制裁打击失当。基于此,时机适当时宜修订关于醉酒型危险驾驶罪的法条规定,构建更为科学的罪状标准;促进《道路交通安全法》和《刑法》在醉驾制裁方面的合理衔接;在全国范围内推广“瑞安模式”,尽快增设“前科消灭”制度,实现醉酒型危险驾驶罪的真正微罪化。The effect of law implementation of drunk driving in the past 11 years is worthy of academic reflection.From the perspective of law and economics,the“one size fits all”incrimination standard may lead to the effect of legal sanctions against drunk driving falling into the non-Pareto improvement zone.The key to solving the controversy lies not in the severity of the legal sanctions,but in their systematic rationality.After drunk driving has been punished by the criminal law,there are three major problems in China's drunk driving sanction that affect its system and rationality,that is,the strict test method of“blood alcohol concentration”for drunk driving,the lack of connection between the Road Traffic Safety Law and the Criminal Law,and the inborn implicit sanction strike of drunk driving sanction system.Based on this,it is necessary to revise the provisions of the crime of drunk dangerous driving,and establish a diversified and orderly standard of conviction,and to promote the harmonization of the Road Traffic Safety Law and the Criminal Law with regard to drunk driving sanctions.The“Ri'an model”should be promoted nationwide,and the“criminal record elimination”system should be added as soon as possible to realize the real micro-criminalization of drunk dangerous driving crime.
