检察机关提前介入监察机制的反思与完善

摘　　要：检察提前介入监察已成为监检衔接的新机制。虽此机制在提高办案质量和效率方面已取得显著成效,但由于此机制尚处于探索阶段,实践中仍存在侧重配合、制约性不足、介入标准呈随意性等问题,亟待完善。学界对此机制也未形成统一认知,主要有法律监督说、公诉准备说和配合制约说。应采取配合制约说对此机制进行反思和完善。在保障监察权独立行使前提下,提高检察机关的制约能力,并构建律师提前介入机制。为防止此机制的滥用,应细化提前介入标准,从介入主体、介入方式等方面进一步规范提前介入程序,推进监检衔接工作规范化。The advance intervention of the prosecution has become a new mechanism to link the supervision and inspection.Although this mechanism has achieved remarkable results in improving the quality and efficiency of case handling,due to the fact that this mechanism is still in the exploratory stage,there are still some problems in practice,such as focusing on cooperation,insufficient regulations,nonnormative and arbitrary intervention procedures and standards,which need to be improved.The academic circle has not formed a unified cognition of this mechanism,which mainly includes the theory of legal supervision,the theory of public prosecution preparation and the theory of cooperation restriction.The theory of cooperative restriction should be adopted to reflect and improve this mechanism.Under the premise of guaranteeing the independent exercise of supervisory power,the restraining ability of procuratorial organs should be improved,and the mechanism of lawyers'intervention should be established in advance.In order to prevent the abuse of this mechanism,the criteria of early intervention should be refined,the procedures of early intervention should be further standardized from the aspects of intervention subjects and ways,and the standardization of supervision and inspection should be promoted.
