摘 要:在互联网环境下,劳动用工形式呈现出工作时间与场所更加灵活、薪酬体系趋于多样化、用工关系更加复杂的特点。由于相关法律法规的滞后性,以及各方主体未对网络劳动关系予以足够重视,导致互联网环境下的劳动法律关系在认定、救济与保障层面存在一定问题,给劳动关系的和谐带来挑战,滋生了一系列现实问题。为减少互联网环境下的劳动关系争议,应明确互联网环境下劳动关系的认定、畅通互联网环境下劳动者维权救济途径,并构建互联网环境下的劳动保障体系。In the internet environment,the form of labor and employment shows more flexible working time and place,more diversified compensation system,and more complex labor relations.Due to the lag of relevant laws and regulations,as well as the lack of enough attention to the labor relations,there are some problems in the determination,relief and guarantee of the labor relations on the internet,which brings challenges to the harmony of labor relations and breeds a series of practical problems.In order to reduce the disputes of labor relations under the internet environment,we should make clear the identification of labor relations,unblock the relief channels of laborers rights,and construct labor security system.
