互联网文化新业态的产业发展与版权保护问题探析

摘　　要：在全面信息化变革的时代,互联网版权保护已成为互联网文化新业态发展的灵魂,互联网新业态绕不开版权,保护版权成为我国互联网文化产业发展的关键。首先从互联网文化产业新业态版权保护现状、保护问题等方面进行分析,指出互联网文化新业态产业版权保护不足,互联网版权侵权的主体界定与归责难等问题。其次,对互联网版权侵权责任主体之网络服务提供者需承担的责任进行梳理与分析;再次,就加强互联网版权保护,培养复合型版权保护人才提出建议。In the era of comprehensive information reform,Internet copyright protection has become the soul of the development of new formats of Internet culture.New formats of Internet cannot bypass copyright,and copyright protection has become the key to the development of China's Internet culture industry.This paper first analyzes the current situation and protection problems of the copyright protection of the new format of Internet cultural industry,and points out the deficiencies of the copyright protection of the new format of Internet cultural industry,as well as the problems existing in the definition and attribution of the subject of Internet copyright infringement,followed by analysis of the responsibilities of the network service provider,which is the subject of Internet copyright infringement liability,and concluded with constructive suggestions.
