论一站式国际商事纠纷解决平台下的商事调解制度——以《新加坡调解公约》为视角

摘　　要：中国近年来建立起诉讼、仲裁、调解有机衔接的一站式国际商事纠纷解决平台,其下的商事调解制度与《新加坡调解公约》下的商事调解制度相比,在调解类型与调解独立性方面尚有很大进步空间。完善一站式国际商事纠纷解决平台下的商事调解,对中国建立现代国际商事调解制度、国际商事法庭运作机制及加强涉外法治建设具有重要意义。中国依据多边主义、私法自治、区别对待原则的指引,加快商事调解法的制定,建立对调解人的约束制度,充分发挥当事人意思自治,对国际、国内商事纠纷暂时可适用“双轨制”调解模式,循序渐进地推动商事调解独立性改革,从而促使一站式国际商事纠纷解决平台下的商事调解制度与现代国际商事调解制度接轨,为中国加强涉外法治建设和参与全球治理提供坚实的法治保障。In recent years,China has established a one-stop international commercial dispute settlement platform that organically links litigation,arbitration and mediation.Compared with the commercial mediation system under the Singapore Mediation Convention,the commercial mediation system under it still has a lot of room for improvement in the mediation type and mediation independence.Perfecting the commercial mediation under the one-stop international commercial dispute settlement platform is of great significance for China to establish a modern international commercial mediation system,improve the operation mechanism of the international commercial court,and strengthen the construction of the foreign-related rule of law.In accordance with the principles of multilateralism,autonomy of private law and differential treatment,we shall accelerate the formulation of China’s commercial mediation law,establish a constraint system for mediators,give full play to the autonomy of the parties,temporarily apply the“two-track”mediation model to international and domestic commercial disputes,and gradually promote the reform of the commercial mediation independence,so as to promote the commercial mediation system under the one-stop international commercial dispute settlement platform to integrate with the modern international commercial mediation system,and provide a solid legal guarantee for China to strengthen the construction of foreign-related rule of law and participate in global governance.
