摘　　要：清代刑部在中央各部中最称烦难,然而刑部制度的发展也最为缜密。清代刑部律学是治事理政的实学,其研究的目的是如何使律例理解起来更加准确,使用起来更加便利,服务于刑部的工作。它由在刑部任职的法律专家所营求与推动,借助于刑部研律的浓郁氛围与便利条件,刑部职员从刑名工作所需,或抄纂例案、或编述律例条文以便适用、或撰制研究著作阐发深义。刑部律学文献的制作,赓续相承,体裁多样、数量庞大、质量上乘,主导了素材,引领了范式,清代刑部律学堪为清代律学的母机。清代刑部律学与刑部制度、刑名人才三位一体,深刻影响了清代国家司法机构的运作与审判工作的质量。Among the six ministries of the central government,the Ministry of Punishment was under the greatest pressure to deal with day-to-day affairs,and its system was also the most rigorous.In the Qing Dynasty,legal studies by the staff of the Ministry of Punishments was the practical scholarship of judging and governing the country,the aim of which was to make the Qing law clearer and more convenient to apply directly.This kind of legal studies was promoted by the legal officials and served the work of the Ministry of Punishment,which depended on the research atmosphere and legal archives of the board.The judicial officials copied and catalogued the leading cases,organized the codes and substatutes,explained the penal code for its users in the Ministry of Punishments.The literatures of legal knowledge made by the judicial officials in the Board of Punishments had rich and varied genre,vast and numerous works and yet of good quality.It had provided the materials and paved the way for the entire legal studies of the Qing Dynasty.The legal studies of the Ministry of Punishment in the Qing Dynasty was the mother machine of the whole legal studies.The system,legal studies and legal technicians of the Ministry of Punishments were the three subjects that had a profound influence on the operation of the judicial organ and the quality of trial practice.
