精神障碍性侵案51例司法精神医学鉴定分析

摘　　要：目的 探讨精神障碍者性侵案例的特征。方法 用自编量表收集2019-2021年经司法精神医学鉴定的51例精神障碍者性侵案例中有关被鉴定人一般人口学特征、案件特征、刑事责任能力评定结果及受害人的年龄、职业分布、文化程度等方面的资料,并进行回顾性统计学分析。结果 51例精神障碍者性侵案例中,被鉴定人以青壮年、无业、初中及以下文化者居多;案件性质为猥亵案占比80.39%、强奸案占比19.61%,作案场所选择公共场所者比例最高,41.18%为家人报案;医学诊断意见中,精神发育迟滞占比47.06%、精神分裂症占比29.41%、其他(包括情感障碍、性心理障碍、器质性精神障碍)占比23.53;最终经过司法精神医学鉴定的被鉴定人中被评定为完全刑事责任能力、限定刑事责任能力、无刑事责任能力者分别占比35.29%、41.18%、23.53%。受害人中14岁以下的女童占64.71%;学生和幼儿是主要群体;初中以下文化程度者占比90.20%。结论 在加强对精神障碍者进行诊疗和监管的同时,需要加强儿童防性侵能力的建设,有必要构建社会、学校和家庭等多位一体的儿童防性侵安全体系,以预防和减少该类案例的发生。Objective To explore characteristics of sexual assault cases among mentally disabled individuals.Methods The paper collected data of 51 cases sexual assault of mental disorders identified by forensic psychiatry from 2019 to 2021 with self-designed scale for analysis and review,inclduing general demography characteristics,case characteristics,criminal responsibility assessment results,age,occupation distribution,and education level of of identified persons.Results Among 51 cases of sexual assault by individuals with mental disorders,majority of identified individuals were young adults,unemployed,with junior high school education or below,for nature of cases,80.39%of cases was obscene,19.61%was rape,and proportion of choosing public places for committing crimes was the highest,with 41.18%reported by family members.In medical diagnostic opinions,mental retardation accounted for 47.06%,schizophrenia accounted for 29.41%,and others(including emotional disorders,sexual psychological disorders,and organic mental disorders)accounted for 23.53%.Identified individuals ultimately assessed as having full criminal responsibility,limited criminal responsibility,and no criminal responsibility accounted for 35.29%,41.18%,and 23.53%respectively based on forensic psychiatry appraisal,64.71%of victims were girls under 14,students and young children were main group,90.20%of them had lower education level than junior high school.Conclusion While strengthening diagnosis,treatment,and supervision of individuals with mental disorders,it is necessary to strengthen construction of ability of children to prevent sexual assault,to build comprehensive safety system for sexual assault prevention of children in society,schools,and families to prevent and reduce occurrence of such cases.
