摘  要:新一代法律智能系统呈现出符号主义与联结主义法律人工智能相融合的趋势。以生成式人工智能ChatGPT为代表的智能系统由大数据驱动,采用机器学习算法挖掘法律文本大数据,在类案检索、判决预测、法律文书自动生成等任务中表现良好,但面临算法的不可解释性等缺陷。法律逻辑学经历了由传统逻辑到现代逻辑的转变,形成了基于规则和基于案例的法律推理模式,在法律专家系统中得到成功应用,其优点是推理的可解释性,但面临知识获取瓶颈的挑战。新一代法律智能系统的融合性道路表现在法律推理与法律文本大数据分析的融合,实现算法可解释性和计算表现力的优势互补。法律逻辑学的现代发展推动了人工智能可解释性问题的解决,启发了“符号-神经网络”的新方法,形成了法律大数据分析的符号化与可解释法律论证挖掘的融合路径。The new generation of legal intelligent systems shows a trend of the integration of symbolism and connectionism approaches in AI and law.Intelligent systems,represented by generative AI,namely ChatGPT,are driven by big data and use machine learning algorithms to mine large amounts of legal text data.These systems perform well in tasks such as case retrieval,judgment prediction,and legal document generation,but they face defects such as algorithmic unexplainability.Legal logic has undergone a transition from traditional logic to modern logic,and has formed rule-based and case-based legal reasoning models,which have been successfully applied in legal expert systems.Its advantage is the explainability of reasoning,but it faces the challenge of the bottleneck of knowledge acquisition.The integration path of the new generation of legal intelligence systems is mainly manifested in the integration of legal reasoning and big data analysis of legal texts,realizing the complementary advantages of algorithm explainability and computational expressiveness.The modern development of legal logic has promoted the solution of the inexplicability problem of AI,inspired a new method of"symbol-neural network",and formed a integration path between the symbolization of legal big data analysis and explainable legal argumentation mining.
