摘 要:基于还原论局限性所形成的黄河治理传统思维和模式已不能适应黄河流域生态保护的需要。体制机制创新应以整体性思维为要旨,以统筹协调代替条块分割,以法治先行为保障。制度建设应符合流域生态环境整体性治理趋势、地方分治向央地共治改革趋势、分散治理向集中治理转变趋势、单一治理向多元治理整合趋势,并充分借鉴长江保护法创建的以流域统筹协调、整体联动的管理体制为重要特征的特别法模式。整体性法律路径的重点是:整体性综合立法模式、协同协调行政管理体制、流域生态环境司法协作机制、流域协商民主机制。The traditional thinking and mode of Yellow River control based on the limitation of reductionism can not meet the needs of ecological protection in the Yellow River Basin. The innovation of system and mechanism should take the overall thinking as the main idea, replace the division of sections with overall planning and coordination, and rule by law as the first guarantee of behavior. In view of the coexistence of scattered and empty legislation, overlapping and lack of coordination in law enforcement, asymmetry in judicial jurisdiction and lack of coordination mechanism, passive participation of the law-abiding public and dilution of consultative democracy, the system construction should conform to the trend of integrated governance of the ecological environment of the river basin, the trend of reform from local separation to central and local co governance, the trend of transformation from decentralized governance to centralized governance, and the trend of integration from single governance to multiple governance, And fully learn from the special law mode created by the Yangtze River Protection Law, which is characterized by the management system of basin coordination and overall linkage. The key points of the integrated legal path are: the integrated comprehensive legislative model, the coordinated administrative management system, the judicial cooperation mechanism of river basin ecological environment, and the democratic mechanism of river basin consultation.
