融贯论视角下的黄河流域生态保护机制审视——以《黄河保护法》相关规定为分析对象

摘　　要：《黄河保护法》是有关黄河保护的综合性法律,该法设计的流域生态保护机制是否科学,直接决定黄河治理的成效,影响黄河流域高质量发展的水平。在考察黄河流域生态保护机制融贯状况的基础上,批判性反思其制度局限,剔除不相协调的冗余内容,能够为该机制的理性重构奠定有益基础。流域统筹协调机制以及政府责任制、考核评价制度具体落实措施的缺失,降低了流域生态保护机制的融贯程度。完善《黄河保护法》配套立法、落实协同治理、完善司法协作的同时,注重行政执法或司法适用活动主体建构性解释、重构相关法律规范,有助于流域生态保护机制内在价值和形式结构上的进一步融贯。The Yellow River Protection Law is a comprehensive law on the protection of the Yellow River. Whether the ecological protection mechanism of the Yellow River basin designed by the law is scientific or not directly determines the effectiveness of the Yellow River control and affects the level of high-quality development of the Yellow River basin. Based on the investigation of the situation of coherence about the ecological protection mechanism in the Yellow River Basin, critical reflection on its institutional limitations and elimination of incompatible redundant content can lay a beneficial foundation for the rational reconstruction of the mechanism. The lack of specific implementation measures of the overall planning and coordination mechanism of the Yellow River basin, as well as the government responsibility system and assessment system, has reduced the coherence of the ecological protection mechanism of the Yellow River basin. While improving the supporting legislation of the Yellow River Protection Law, implementing collaborative governance, and improving judicial cooperation, attention should be paid to the constructive interpretation and reconstruction of relevant legal norms by relevant subjects in administrative law enforcement or judicial application activities, which will contribute to the further integration of the intrinsic value and formal structure of the watershed ecological protection mechanism.
