摘　　要：中国环境法学的跨域性和非自决性决定了其研究进路除了内部视角,也需要从社会层面观察环境法律现象的外部视角,这使社会理论介入环境法学有了可能。社会理论古典大师马克思关于人与自然、人与社会、社会与自然联系的经典论断揭示了环境问题的社会性和场域性,提出了研究进路多元化的要求,是中国环境法学社会理论进路的思想基础和逻辑起点。社会理论的研究进路,不仅助益于本土环境法文化的底蕴挖掘和现时塑造,为环境法规范意涵的法理论证提供外部论据,而且可以推动环境法制度的自主创新,明确环境法学科的属性定位。中国环境法学对社会理论的接纳并无意弱化甚至否定环境法教义学进路的重要性,实际上,借助社会理论的外部加持能够促进环境事理向环境法理的转化。两种进路各有作用场域,理应互补余缺、适度结合,从而构建中国环境法学研究的多元格局。The cross-domain and non-self-determination of Chinese environmental law doctrine determines that in addition to the internal perspective,the research of Chinese environmental law also needs the external perspective of observing environmental legal phenomena from the social level.The social theoretical approach of Chinese environmental law is facing an opportunity and is possible.Marx's discussion on the relationship between man and nature reveals the social and field nature of environmental issues,and puts forward the requirement of diversifying research approaches.It is the ideological basis for Chinese environmental law to accept social theories,as well as the logical starting point of how social theoretical approaches are possible.The observation angle and research approach of social theory not only contribute to the excavation and current shaping of the local environmental law culture,but also provide external arguments for the legal proof of the connotation of environmental law norms,and can also enlighten the independent creation of the environmental legal system,as well as understanding the cross-sectoral landscape of environmental law disciplines.The acceptance of social theory by Chinese environmental law has no intention to weaken the importance of environmental law doctrine or to resist its approach.The external support of social theory can promote the transformation of environmental reasons into environmental legal theories.The two approaches have their respective fields of action,they should be combined appropriately and complement each other,so as to build a diverse situation of environmental law research in China.
