摘　　要：针对司法鉴定中因混产品质量特性从属关系导致的质量问题的判断不准确或不正确的现状,和因产品质量特性重要度缺乏分析导致的质量问题对产品实用性的影响程度判断不够明确的现状,通过对实际案例的产品质量特性从属关系和质量特性重要度展开分析,阐明了司法鉴定中产品质量特性及重要度确认的重要性。得出结论:司法鉴定中应根据鉴定事项中涉及的质量特性进行从属关系确认,进而对质量特性要求的符合性进行分析判定,进而通过质量特性重要度给出质量影响程度的评价;明确的质量特性从属关系、明确的质量特性符合性和明确的质量影响程度,会使鉴定结论更完整,有助于提升司法鉴定的公信力,更能为司法判定提供可靠、科学、有力的技术支撑。Aiming at the current situations of inaccurate or incorrect judgment of quality problems caused by the confusion about the affiliation of product quality characteristic in judicial expertise,and the judgment of impact degree of quality problems on product practicability is not clear enough due to lack of analysis of product quality characteristic essentiality.Through the analysis of product quality characteristic affiliation and quality characteristic essentiality in actual cases,the importance of product quality characteristic and essentiality confirmation in judicial expertise is clarified.It is concluded that the judicial expertise should confirm the affiliation according to the quality characteristic involved in the expertise,and analyze and determine the required conformity of quality characteristic,and then give an evaluation of the degree of quality impact through the quality characteristic essentiality.Clear affiliation of quality characteristic,clear conformity of quality characteristic and clear degree of quality impact will make the expertise conclusion more complete,and help to enhance the credibility of judicial expertise.It can provide a reliable,scientific and powerful technical support for judicial expertise.
